WHEREAS, the City of Moody, Alabama (the "City") owns a parcel of real property upon which it has constructed recreational facilities and fields for located at the intersection of Interstate 20 and Highway 78, which is more particularly described below: and
WHEREAS, it is the opinion of the City Council of the City of Moody, Alabama, that the property is not now needed for public or municipal purposes except as provided for herein; and
WHEREAS, the mission of The Miracle League Association ("Miracle League") is to provide recreational support and opportunities for children with disabilities; and
WHEREAS, the Miracle League constructs special recreational facilities known as "Miracle League Fields" on which children with disabilities compete; and
WHEREAS, the Miracle League allows those children with physical and mental disabilities to participate in an organized recreational program just like their brothers, sisters and friends; and
WHEREAS, the Mayor and City Council of the City of Moody, Alabama, ahs previously determined that the endeavors of the Miracle League will enrich the lives of the disabled children as well as their families and their communities and will promote the public health, safety and welvare of its citizens; and
WHEREAS, the Miracle League has submitted an offer to lease a small part of the said real property; the same being more particularly depicted on the map attached hereto as Exhibit "A" and made a part hereof:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOODY, ALABAMA, AS FOLLOWS:
Section 1. It is hereby extablished and declared that the following described real property in the City of Moody, Alabama, is no longer needed for public or municipal purposes except as more particularly described herein, to-wit;
Section 2. That City having received an offer from Miracle League to lease the real property described in Section 1 hereof for the purpose of constructing special facilities and for providing an organized recreational program for those children with physical and mental disabilities, it is hereby declared to be in the best interest of the public and City of Moody, Alabama, to lease said real property to the Miracle League pursuant to the terms and conditions ofj the Ground Lease, a copy of which is on file in the Office of the City Clerk, whereby the City of Moody, Alabama.
Section 3. That pursuant to the authority granted by Section 11-47-21 of the Code of Alabama (1975), the Mayor and other authorized representatives of the City of Moody, Alabama are authorized and directed to execute the said Ground Lease in the name of the City of Moody, Alabama.
Section 4. This Ordinance shall become effective immediately upon its adoption and publication as required by law.
