Mr. Kyle Shelton, Editor of the St. Clair Times newspaper, tells me that there was apparently a change in Section 1, below, before final passage of this ordinance. Where the copy of the ordinance I have copied says "not less than $200,000 per year", the final ordinance apparently reads "not to exceed $200,000 per year". Section - 1: That ADESA of Birmingham, Inc., an automobile wholesale dealer selling automobiles through a private auction in the City of Moody, Alabama, shall pay a license fee of Five Dollars ($5.00) per vehicle sold provided that said license fee shall not be less than two hundred thousand dollars ($200,000.00) per year. Section -2: That said license fee shall be payable on October 1st of each year and shall become delinquent on January 1st of such license year. The City Clerk must collect a penalty of ten percent (10%) on all licenses not paid before January 1st; twenty percent (20%) on all licenses not paid before February 1st; thirty percent (30%) on all licenses not paid before March 1st; forty percent (40%) on all licenses not paid before April 1st, and fifty percent (50%) on all licenses not paid before May 1st of such license year. Unless the full amount owing together with the penalty herein provided is paid, no license shall be issued to any applicant thereof. Section - 3: That all ordinances or parts of ordinances in conflict herewith, are to the extent of such conflict, hereby repealed. Section - 4: That this ordinance shall become effective upon passage, approval and publication as required by law. |
